A Warning on Self Prepared Amendments, Attempts & Amendments

Please be advised that we cannot and will not involve ourselves
in the approval, review, or legal sufficiency of any amendment or
codicil prepared independent of this office. There should be no expectation
of legal advice, legal review or any attorney-client relationship
from our office for any self prepared amendment or any other amendment
prepared outside of this office even if the document or copy has
been forwarded to our office. For practical and liability reasons
we either have to prepare the amendment or have nothing to do with
it at all. If you wish to engage our law office to prepare documents
and/or advise and represent you in this matter you must follow the
policies and procedures set forth in “Amending Your Trust”.
A Warning on Self Prepared Amendments: While it is possible that
an amendment or codicil prepared independent of this office may be
legally sufficient our experience indicates that it is highly likely
that a change you attempt to make on your own can cause significant
problems regarding distribution of your estate, and undermine the
integrity of your intended estate plan. It may also create serious
ambiguities and raise questions at your death. Rather than carrying
out your intentions, a self-prepared amendment often results in completely
thwarting and defeating your intentions. That is why we advise you,
in the strongest of terms, to immediately seek competent legal counsel
to draft and prepare your amendment and address your goals.
